为劳动者缴纳社会保险费是《社会保险法》、《劳动合同法》明文规定的用人单位应当承担的法定义务。根据《劳动合同法》第三十八条、第四十六条的规定,用人单位未履行该法定义务导致的后果之一是劳动者以此为由离职的可要求用人单位支付经济补偿金。用人单位多会依法为劳动者建立社保账户,但实务中未依法足额缴纳社保的情形屡见不鲜。对于未足额缴纳社保是否属于前述规定中用人单位应当支付经济补偿金的情形,法律并未明文规定,殊不知,实务中各地对此规定不一,用人单位仍可能面临被员工要求支付经济补偿金的风险。

外卖骑士在工作期间出现交通事故,赔偿责任有时候由外卖平台承担,有时候要骑士自身承担,有时候还由不知名的第三方承担。到底谁来承担赔偿责任,受害人应该向谁主张权利,这本来应该是一个有规可循的事情,因为,根据《侵权责任法》的基本原则,当存在“用工关系”(包括劳动关系、劳务关系、雇佣关系以及劳务派遣关系)时,执行工作任务的人员对他人造成损害的,由分配工作任务的单位(统称“用工单位”)承担侵权责任。但如今,外卖骑士与外卖平台之间的关系五花八门,外卖骑士引起的损害赔偿责任谁来承担,也变得不那么简单。
