wigley_richardThe framework for variants of class action-type litigation in the People’s Republic of China has been in place since the initial promulgation of the Civil Procedure Law of the P.R.C. (“CPL”) in 1991.   The recently amended CPL provides requirements for filing a “joint litigation” for suits where “the object of the action is of the same category and a party consists of numerous persons” and where the parties may choose to elect a representative.[1] Further to whether standing is afforded the plaintiff and the filing requirements for such litigation, the CPL provides that “[t]he plaintiff must be a citizen, legal person, or an organization having a direct interest with the case … there must be a specific defendant … [and] there must be a specific claim and a specific factual basis and grounds ….”[2] Though with certain differences, the CPL provides a framework which allows for joint litigation which has similarities to what is commonly referred to as a “class action lawsuit”. The combination of the two largest developing economies (China and India) in the world with other developing countries, as well as other established developed countries, makes Asia one of the leading areas for infrastructure investment over the next decade (2015 to 2025).

The Asian Development Bank estimates the demand at USD730 billion each year for the next decade.[2] In South East Asia alone an estimated $2.5 trillion in investment will be needed over the next ten years, with one third to be spent on transport, one third on electricity, and the remainder on water supply and sanitation, solid waste management, telecommunications and irrigation. [3] The appetite for infrastructure makes Asia a key region for infrastructure investors – offering significant opportunities for growth over the short, long and medium terms.

untitleduntitledSince China’s ambitious ‘One Belt, One Road’ initiative (“Initiative”) was first introduced in October 2013 by President Xi Jinping, the rest of the world has been playing close attention to how this major pillar of China’s economic policy will impact its integration with the global economy. It is being heralded as a blueprint for greater cooperation and integration through the development of an infrastructure network connecting all sub-regions in Asia, and between Asia, Europe and Africa.

In recent months, the Initiative has gained significant momentum with the unveiling of an overall strategic plan in March entitled “Vision and Actions Outlined on Jointly Building Silk Road Economic Belt and 21st-Century Maritime Silk Road” (“Vision and Actions”) by the National Development and Reform Commission, the Ministry of Foreign Affairs and the Ministry of Commerce.

In particular, it places a strong emphasis on orienting the Maritime Silk Road towards the Association of Southeast Asian Nations (ASEAN), accelerating the development of the Initiative.
