ning_susanThe Provisions on the Management of Internet News Services[1] (the “Provisions”) were released by the Cyberspace Administration of China (“CAC”) on 2 May 2017. Issued jointly by the State Council Information Office (“SCIO”) and the Ministry of Information Industry, the Provisions replace the previous provisions from 2005 (the “2005 Provisions”). They establish a brand-new regulatory framework and approach in response to the development of the Internet over the last decade, responding to the growth of self-media and diversified means of communication. The Provisions are expected to open up a new era of Internet news regulation in China.

陆慧文At the end of 2015, the Administrative Examination and Approval Reform Office of the State Council decided to integrate the Employment Permit for Foreigners (issued by the Ministry of Human Resources and Social Security) and the Foreign Expert Work Permit (issued by the State Administration of Foreign Experts Affairs) into the Foreigner’s Work Permit in China. This new policy has been implemented nationwide since 1 April 2017. Being more than just a simple combination of permits, the “Two-in-One License” reform realizes the unified management of foreigner’s employment in China. Below are highlights of the new policy.

lu_lucy2015年底,国务院审改办决定将人社部负责的“外国人来华就业许可”和国家外国专家局实施的“外国专家来华工作许可”整合为“外国人来华工作许可”。新版许可自2017年4月1日起全国统一实施。“两证整合”不仅是简单合并,而是统一外国人来华工作管理服务,对于这一新政的亮点,我们作出如下简要解读,以供参考。

统一证件名称 

本次新版许可在旧版的基础上,对许可证书进行了整合。原《外国专家来华工作许可证》、《外国人就业许可证》统一整合为《外国人工作许可通知》,采用电子化在线打印;原《外国专家证》和《外国人就业证》统一整合为《外国人工作许可证》。《外国人工作许可证》作为外国人在中国工作的合法证件,一人一号、终生不变。

近日,一则顺丰快递在行业内首推“隐形面单”的新闻[1]引发关注。根据相关报道,顺丰快递此次推出的实际上是一个名为“端到端全流程信息安全解决方案”的用户个人信息综合保护技术方案,主要包括以下三方面举措:

  1. 对快递面单上的用户姓名、电话号码、地址等个人信息进行隐藏或编码,从而实现用户个人信息在快递面单上的全面加密化。
  2. 针对企业内部可能接触到用户个人信息的各个环节及其工作人员,如收派员、客服人员等,实现用户个人信息的全流程隐藏。
  3. 逐步进行全国范围内的地址编码工作,以期以编码来全面取代用户个人的真实地址信息。

ning_susanThe reform and opening up in China has been a process of establishing and improving a modern market system. As this process deepens, “building a unified, open, orderly and competitive market” has become the goal of the market economy reform. The year 2017 is the second year of China’s 13th Five-year Plan, in which “market” and “competition” are the key points that cannot be overlooked. According to the Plan, establishment of a modern market system requires accelerating the development of a unified, open, orderly and competitive market, establishing mechanisms for ensuring fair competition, overcoming regional segmentation, breaking up industry monopolies, and removing market barriers in order to promote the free and orderly flow and equitable exchange of goods and factors of production [1]

The Plan obviously lays an unprecedented emphasis on the market’s fundamental role in resource allocation. Meanwhile, the government is taking or strengthening regulatory measures to control market disrupting risks, resorting to the law to ensure orderly operation of the market economy and to resolve externality problems of the market. Compliance issues regarding anti-corruption, employment, tax, anti-monopoly, and environmental protection are now under strict government supervision. Reinforcing the compliance system, therefore, by incorporating it into the “Now Normal” management mechanism is a path enterprises must take in their development.

由此可见,十三五规划前所未有的重视市场在资源配置中的基础作用,同时,政府也采取和加强各项监管措施严控扰乱市场的各项风险,以法律为手段保障市场经济的有序运行,力图解决市场外部性问题。反腐败、劳动、税务、反垄断、环保、海关等合规问题成为政府严格把关的重点。因此,强化企业合规体系,将合规经营纳入“新常态”的管理机制已经成为企业发展的一个必然新趋势。
