The transaction represents By-Health’s first major outbound acquisition in the Australian healthcare industry, with Life-Space operating the Evolution Health and Ultramix businesses as well as the Life-Space brand of probiotics. 不久前，医疗整形互联网企业北京新氧科技有限公司(“新氧公司”)开发的新氧APP疑因新氧公司不拥有第9类商标（下文中如无特别说明，本文中所称“第9类商标”是指使用在《类似商品和服务区分表》第9类中“可下载的计算机应用软件”和“可下载的手机应用软件”等商品和类似商品上的商标）而被苹果应用商店下架[1]，但新氧公司在不久之后做出回应，声明第9类商标并不涉及其核心业务[2]，称“目前新氧作为一家医美社区和电子商务平台公司，其核心业务主要聚焦线上，为信息服务提供平台，并不涉及实体商品的生产”。目前用户仍然能够在苹果应用商店中检索并下载新氧APP，似乎新氧公司的移动端业务并未受到严重影响。然而，过去却不少有知名企业的APP在第9类商标问题上遭遇狙击，有些甚至付出了较大代价，例如： Continue Reading 移动终端APP名称是应用软件的商标吗？
