Txu_xiaodanhe Amendment of the PRC Population and Family Planning Law has been officially implemented as of January 1st, 2016. The aforementioned Amendment has changed China’s previous one-child policy to one that encourages couples to have a second child, establishing the “two-child policy”, under which couples are allowed to have additional children if legal requirements are met.

The issue to be addressed here, is whether an employer may terminate an employee’s employment contract, if the latter violates the national family planning policy by giving birth to a third child. This issue has baffled employers for a long time, over which no unified opinions have been formed in judicial practice.

《xu_xiaodan人口与计划生育法》修正案已于2016年1月1日起施行。修正案将原先国家“提倡一对夫妻生育一个子女”的规定修改为“提倡一对夫妻生育两个子女”，确立了“全面二孩”政策。在新政策下，如果公民符合法律、法规规定条件的，可以再生育子女。

那么，如果员工违反国家生育政策生育三孩，用人单位能否以此为由与其解除劳动合同？对于这一长期以来困扰用人单位的问题，司法实践尚未形成统一观点。

历时十年谈判和一年多的微调后，备受期待的《中澳自由贸易协定》（ChAFTA）于2015年6月17日签署，并终将于同年12月20日生效，中国与发达国家签署的条件最为有利的贸易协定由此尘埃落定。

After a decade of negotiations and over a year of fine tuning, the much anticipated China-Australia Free Trade Agreement (ChAFTA), which was signed on 17 June 2015, will finally come into force on 20 December 2015, cementing the most favourable trade deal that China has concluded with any developed economy.

Under the agreement, more than 86 per cent of Australia’s goods exports to China (worth more than $86 billion in 2014) will enter duty free, rising to 96 per cent when ChAFTA is fully implemented on 1 January 2016.

AZhou_Xin new cross border financing management regime implemented in China’s four free trade zones

On 22 January 2016, China’s central bank promulgated a notice entitled the PBOC Circular Regarding the Expansion of the Pilot Program of Prudent Macro Management of Cross-border Financing (“PBOC Circular”). According to the PBOC Circular, a new unified cross border financing management regime will be implemented as of 25 January 2016 in China’s four free trade zones, including Shanghai Free Trade Zone, Guangdong Free Trade Zone, Tianjin Free Trade Zone and Fujian Free Trade Zone.
