dang_zheOn 30 December 2016, the KWM IP litigation team helped US Deere & Company and its Chinese subsidiary John Deere (China) Investment Co., Ltd. (“Deere China”) win at first instance a lawsuit involving trademark infringement and unfair competition. The Beijing IP Court confirmed that Deere & Company’s trademarks, “JOHN DEERE” in Classes 7 and 12, and “约翰.迪尔” in Class 7 were well-known marks It ordered the three defendants to cease infringement,, make a public statement to eliminate adverse effects, found unfair competition and awarded the plaintiff RMB 5 million in punitive damages and RMB 360,000 in reasonable expenses. On 10 January 2017, at a press release for the second anniversary of the Beijing IP Court, the case was selected as a paradigm of “strengthening judicial protection of IPRs”.

The Center for Strategic and International Studies (CSIS), a non-profit policy research organisation in the United States, estimates that the theft of data and other IP results in a global cost between $450-600 billion each year.

To help counter this threat, the CSIS recently published a set of cybersecurity recommendations for the incoming Trump administration (CSIS Recommendations). In fact, cybersecurity issues were a recurring concern throughout the recent US presidential election campaign, and despite the CSIS recommending against a wholesale review, it was widely thought that on coming into power President Trump would sign an executive order mandating an immediate review of all US cyber defences and vulnerabilities. While no such order has yet been made, there is every likelihood that the Trump administration will give weight to the CSIS Recommendations, with Karen Evans, the co-chair of the recommendation taskforce, being a member of Trump’s transition team.

yin_juquan考勤制度对于用人单位而言既是必要的也是尤为重要的,而通过检查员工“打卡”的情况进行考勤是最常用也是最直接有效的方式。这样一来,“打卡”后离岗、托他人代为“打卡”等“虚假考勤”的违纪行为在用人单位用工过程中时有发生,用人单位可否因员工存在“虚假考勤”行为而认定严重违反规章制度从而单方解除该员工劳动合同?法律法规并未对“虚假考勤”行为是否属于严重违反规章制度的行为作出规定,实务中确实存在用人单位因此与员工单方合法解除劳动关系的情形,本文结合实务案例对该合法单方解除劳动合同的情形作简要总结和分析。

jiang_junluSince the idea of the Ethnic Chinese Card (“ECC”) was raised by Hong GUO (Director of the Administrative Committee of Zhongguancun) on 27 November 2015, Chinese communities worldwide have been following the discussion with interest.

On 13 March 2016, Yuanping QIU, Director of the Overseas Chinese Affairs Office, stated in an interview that China had no plans to launch the ECC. At the end of 2016, the ECC once again came into the media spotlight, but the most recent official statement remains that of Director QIU. The Administrative Committee of Zhongguancun has proposed to pilot the ECC system but when this will happen is unclear.

陆慧文Annual leave is an important reflection of the right to rest granted by law to employees.  The introduction of the annual leave system has made the taking of holidays a hot topic amongst both employees and employers.

Mr. Zhang, a resident of Zhangjiang, Shanghai, quit his job on 10 March 2012. Four days later, on 14 March 2012, he commenced employment with a new company. For the following five years he worked relentlessly without taking annual leave. At the end of 2016, Zhang’s employers decided not to renew his contract. They refused to compensate him for the five years of annual leave he had accrued whilst working for them. Compensation that we say he is entitled to.
