yin_juquanA document that certifies the cancellation or termination of an employment contract is known as a severance of employment certificate. Pursuant to Articles 50 and 89 of the PRC Labor Contract Law, if an employment contract between an employer and an employee is canceled or terminated, the employer must issue a document promptly certifying the cancellation or termination of the contract; if the employer fails to perform this obligation, it shall be liable for compensating the employee for any losses incurred therefrom. Apart from the aforementioned provisions, there are no further requirements stipulating how an employer is liable for compensation in any existing laws, administrative regulations or rules. This article analyzes through case study an employer’s compensation liability for withholding a severance certificate.

yin_juquan解除或者终止劳动合同的证明,俗称离职证明。根据我国《劳动合同法》第五十条和第八十九条的规定,用人单位在与劳动者解除或者终止劳动合同时应及时出具解除或者终止劳动合同的证明,未及时履行该义务的并给劳动者造成损害的,应当承担赔偿责任。虽有前述如此规定,但并无法律或行政法规、规章对用人单位如何承担该赔偿责任作进一步具体的规定,本文以案例着手对用人单位如何承担未及时出具离职证明导致的赔偿责任进行简要分析。

luo_aiOn 12 June 2016, a draft amendment to the Water Pollution Prevention and Control Law of the People’s Republic of China (Consultation Paper) (the “Draft Amendment”) was released by the Ministry of Environmental Protection (“MEP”) on its official website. It is the first large-scale amendment to the Water Pollution Prevention and Control Law since it took effect in 2008. On 7 December 2016, the Draft Amendment was reviewed and adopted at the executive meeting of the State Council, to be submitted to the Standing Committee of the National People’s Congress (“NPC”) for consideration.

We note that the Draft Amendment contains significant changes to the industrial emissions licensing system, water pollution control and treatment and the exit of highly polluting enterprises, with more demanding requirements for polluters and stricter provisions on their legal liability. Once the Draft Amendment is adopted and takes effect, it will greatly affect polluting enterprises. What shall those affected do about it? This article aims to sort out and analyze the key issues addressed in the Draft Amendment.

chen_armstrongThe National Security Law, effective as of July 1, 2015, states that “(the State shall) enhance network and information security protection capabilities, strengthen innovative research, development and application of network and information technology, achieve safe and controllable network and core information technology, critical infrastructures and information systems and data in key areas”. Article 31 of the Cyber Security Law of the People’s Republic of China, effective as of June 1, 2017, stipulates that “the State shall, based on the classified protection system for cyber security, focus on protecting both the key information infrastructure used for public communications and information service, energy, transport, water conservancy, finance, public services, e-government affairs and other important industries and fields and other key information infrastructure that will result in serious damage to the national security, national economy and people’s livelihood and public interests if they are destroyed, there are lost functions or they are subject to data leakage”. These provisions pose new challenges to financial institutions in their protection of personal information.
