近日，金杜知识产权诉讼团队代理的迪尔公司（Deere & Company）诉约翰迪尔（北京）农业机械有限公司等三被告商标侵权及不正当竞争案迎来了终审胜诉。北京市高级人民法院（“北京高院”）在本案二审判决中确认，商标法第十三条第三款的规定适用于注册商标与相同类似商品上在先注册的驰名商标发生冲突的情形。据我们所知，本案应属首例确认上述法律适用规则并据此认定和保护在先驰名商标的民事终审判决。 Continue Reading 首例在相同类似商品上认定驰名商标的民事案件终审审结

当前，国内有关PPP协议[1]的争议解决机制，众说纷纭。有观点认为，特许经营协议为行政协议，属于行政法院受案范围而不可由当事人约定，且《仲裁法》第二条将“依法由行政机关处理的行政争议”排除在仲裁范围外，因此特许经营协议中不能约定仲裁条款，不可约定通过民事诉讼解决，只能提交行政诉讼解决。也有观点认为PPP协议更多体现民商事性质，应允许当事人约定仲裁和民事诉讼等争议解决机制。同时，基于最高法院在有些案例中将特许经营协议认定为民商事协议、而在另外案例中认定为行政协议，不乏观点认为应区分PPP协议或争议性质判断纳入民事诉讼还是行政诉讼。但目前国内立法和司法实践中，并未确立区分PPP争议性质的清晰标准。 Continue Reading 他山之石： “一带一路”国家 PPP协议争议解决机制经验借鉴
