O陈运nly three days after the promulgation of the Circular on Improving Individual Bank Account Services and Strengthening Account Management (the “New Individual Bank Account Circular”), People’s Bank of China (PBOC) promulgated the Administrative Measures for Internet Payment Services of Non-banking Payment Institutions (the “New Non-banking Internet Payment Measures”) on December 28, 2015. The New Non-banking Internet Payment Measures also introduce three categories of payment accounts and likewise require that non-banking payment institutions impose classified management based on the real name system with respect to different categories of internet payment accounts.

Cwigley_richardhinese consumers who have purchased and have used mobile phones/devices (including smartphones, smart tablets, and smart watches) often find that said phones/devices include pre-installed applications. These applications may be core to the function of the phone/device or, alternatively, be included by the manufacturer/distributor to provide value-added services/functionality to the user. There has been, however, a growing concern amongst Chinese users of such phones/devices in regards to certain of these pre-installed applications whereby users claim that said applications may be carrying out unwanted functions such as monitoring (and, in some cases, stealing) their personal data or simply taking up unnecessary bandwidth. Such users would, firstly, like to be informed of the presence of such applications upon purchase and, if desired, be given the opportunity to actually uninstall these applications. Legal claims involving such pre-installed applications have, in certain cases, been the basis for litigation in the P.R.C.With this as a background it is not surprising that P.R.C. government has responded with proposed regulatory guidelines for such pre-installed applications, as will be discussed as follows.

Cwan_eonsider this situation: a dispute has arisen between two parties in relation to an agreement which is subject to an arbitration clause. Separately, a winding up application has been made against one of the parties to the arbitration in the jurisdiction in which it is incorporated. An arbitral award is obtained against the potentially insolvent company. That company has assets in Hong Kong, against which the creditor is now seeking to enforce their rights. Due to Hong Kong courts’ generous enforcement of arbitral awards, the lead up to a winding up order may prove to be a costly time for a foreign liquidator and other creditors of the foreign company.
