关于综艺节目模式能否受到著作权保护，这在国内外都是难题。就我国而言，从早期的ECM“go bingo”案、世熙传媒“面罩”案、《超级女声》涉嫌抄袭《Pop Idol》、“take me out”等纠纷到近些年的《极限挑战》涉嫌抄袭《无限挑战》、《非凡搭档》涉嫌抄袭《极速前进》、《中国有嘻哈》被指抄袭等纠纷，权利人均面临着无法通过著作权法维护权益的困境，只能放弃通过诉讼途径维权的做法或转而寻求《商标法》、《反不正当竞争法》对该模式中的部分元素予以保护。但是正如加拿大律师Leonard Glickman所言，给予节目模式商标保护确实是重要的，但与之相比，为该种节目模式能获得版权法的保护而战斗（即使其结果是不确定的）是更重要的。[1]我们对该观点深表赞同，本文将从困境产生的原因、给予综艺节目模式著作权法保护的现实意义等几方面入手，来探讨给予综艺节目模式著作权法保护的可行性。 Continue Reading 综艺节目模式的著作权法保护之道

2017年是《网络安全法》（以下简称“《网安法》”）正式生效施行的元年，也是承前启后的一年。《网安法》是对以往我国各行业网络安全监管制度的一次系统性的梳理，同时在“国家网信部门统筹协调，各行业主管分别负责”的新监督管理体系下，《网安法》的生效施行也标志着我国的网络安全监管进入了新的发展阶段。
